Federal Judge Strikes Down Restaurant Suit

On Friday, Judge Maloney of the Western District of Michigan, denied the Michigan Restaurant & Lodging Association’s (the “MRLA”) motion to issue a temporary restraining order against the Michigan Department of Health and Human Services (the “MDHHS”).  In support of its motion, the MRLA alleged that the MDHHS’s November 18, 2020 order violated the federal and state constitutions.  As a result of Judge Maloney’s decision, the MDHHS’s order limiting gatherings, prohibiting in-person dining, and requiring people to wear facemasks remains in full force and effect.
