Know Your Employment Rights

On March 26, 2020, Attorney General Dana Nessel issued a press release entitled “AG Nessel to Michiganders: Know Your Employment Rights.”  AG Nessel’s press release provides information and answers to questions about legal rights of employees and employers under Governor Gretchen Whitmer’s Stay Home, Stay Safe Executive Order.  Her press release also provides information on which types of employers are considered “critical infrastructure workers.”  The Know Your Employment Rights website also includes various examples of critical infrastructure industries and summarizes Governor Whitmer’s Executive Order.

As an employer, it is critical that you closely evaluate whether your industry can be part of the “critical infrastructure.”  If so, you need to be there to obtain and provide the appropriate designations for your work and your employees.

Our firm has learned that local police are contacting local employers and questioning them about their operations.  Employers who are still operating need to be aware that these investigations are taking place and need to be prepared to respond.  Please contact our firm to develop a response strategy.
