Employers Required To Post Revised EEOC Poster
On October 20, 2022, the Equal Employment Opportunity Commission (“EEOC”) released a revised “Know Your Rights” poster. This revised poster updates and replaces the prior “Equal Employment Opportunity is the Law” poster and clarifies that sex discrimination covers discrimination based on sexual orientation, gender identity, and pregnancy (including related conditions). The EEOC requires all covered employers to place the posters in a conspicuous location in the workplace where notices to applicants and employees are customarily posted. Generally, covered employers include private employers with 15 or more employees, labor unions, employment/staffing agencies, state and local government employers, and educational institutions.
No specific deadline to post the revised EEOC poster has been issued. However, the EEOC has advised that “employers should remove the old poster and display the new one within a reasonable amount of time.” Failure to comply may result in noncompliance penalties from the EEOC. Therefore, employers should replace their “EEO is the Law” with the “Know Your Rights” poster as soon as practicable. Employers should post the version marked “Revised 10/20/2022.” A copy of the poster can be found here:

If employers have specific questions about EEOC poster requirements or their contents, employers should contact Nikole Canute, Scott Dwyer, Nate Wolf, Dominic Clolinger, or Kathryn Zoller as soon as practicable.
