Michigan Court of Appeals Overturns Lower Court on Paid Sick Leave and Minimum Wage

On January 26, 2023, the Michigan Court of Appeals rendered a decision overturning the Michigan Court of Claims in a case revolving around Michigan’s paid sick leave and minimum wage requirements.  With this decision, the looming February 19, 2023 deadline for the expected increase in the minimum wage and implementation of changes to paid sick leave is no longer applicable.  Although the case will almost certainly be appealed to the Michigan Supreme Court, employers do not need to implement any changes at this time.

For more information on the lower court case and what changes were potentially going to be implemented, see our previous Client Alert dated December 22, 2022.

We will continue to monitor the developments surrounding the status of these laws.  If employers have specific questions, they should contact Nikole Canute, Scott Dwyer, Nate Wolf, Dominic Clolinger, or Kathryn Zoller as soon as practicable.

Let’s start a partnership worth keeping.
