Dan Kubiak’s Article “If Seventh Circuit ‘Got It Right,’ Standard Regarding ‘Indication’ of Collateral Needs a Tune-Up” is Published in ABI Journal

Dan Kubiak’s article “If Seventh Circuit ‘Got It Right,’ Standard Regarding ‘Indication’ of Collateral Needs a Tune-Up” was published in the November 2020 edition of ABI Journal. In the article, Dan reviews a recent Seventh Circuit opinion and explains that a UCC-1 financing statement filing system that permits secured creditors to describe their collateral by referencing security agreements or other financing documents not included with the financing statement filing is not practical or workable. He suggests that UCC 9-504 should be revised to require financing statements to provide a collateral description that “reasonably describes the items of collateral.” For more information on this topic, please contact Dan Kubiak at 616-632-8018 or dkubiak@mikameyers.com.
